Building Regulations Explained

One of the things that catch people out when they are selling or buying a new property is the lack of Building Regulation sign off. In England and Wales, Building Regulations are set out in the Building Act 1984 which is regularly updated. The government produces approved document which describe in detail how to comply with the rules. Building Regulations cover all aspects of construction from structural stability, fire safety, drainage to energy efficiency.

 

So when is approval needed?

  • Removing or altering any loading walls;
  • Extending the existing building;
  • Putting up a new building;
  • Replacing roof coverings;
  • Replacing windows & doors;
  • Installing a bathroom or washing and sanitary facilities that require plumbing;
  • Installing an air conditioning system;
  • All drainage works;
  • Replacing hot water cylinder and duel burning appliances;
  • Installation of cavity wall insulation;
  • Replacing fuse boxes and connected electrics;
  • Underpinning of the foundations.

 

It is important that you check with your local authority about the works you are planning to undertake prior to commencing.

Building regulations can get involved after completion of the works however it is likely they will require invasive opening up works which will cost you more in the long run.

If a building remains non-compliant as the owner of the building you can be prosecuted and fined as well as being made to fix the issues they raise.

Should you not get building regulation sign off this will be raised when you try to sell your property and may cause additional costs and problems.

 

How do you apply for Building Regulations?

Tradespeople who are registered with the Competent Person Schemes can self-certify that their work complies with the regulations so you don't need to apply. They will issue you with a certificate on completion of the works.

If they are not registered or the work is classed as substantial you, as the building owner will be required to apply for Building Regulations approval.
